Terms of Service

Welcome to Strata Music ("Strata," "we," "us"), a sole proprietorship operating in Massachusetts, USA, under the registered business name "Strata Music." These Terms of Service (the "Terms") are a binding agreement between you and Strata governing your use of stratamusic.io and everything on it (the "Service"). By using the Service, or by placing an order, you agree to these Terms and to our Privacy Policy and Refund Policy, which are incorporated here by reference. If you don't agree, don't use the Service.
1. What the Service is
Strata analyzes the listening-history export you request from Spotify or Apple Music and turns it into visualizations, statistics, and generated artwork, processed in your browser. The core Service is free. Optionally, you can (a) generate an AI-written "Reading" using your own Anthropic API key, and (b) purchase physical merchandise printed with artwork generated from your data.
2. Eligibility and age
You must be at least 13 years old to use the Service. You must be at least 18 years old to make a purchase, or have a parent or legal guardian place the order for you. By using the Service you represent that you meet these requirements and that you are able to form a binding contract.
3. No accounts
Strata has no login and no user accounts. You are responsible for keeping your own uploaded files, downloaded designs, and save files secure on your own devices and in your own email.
4. Your data and your responsibilities
- You may only upload listening-history data that belongs to you or that you have permission to use, and you must not upload anyone else's personal data without their permission.
- Your uploaded data remains yours. We claim no ownership of it. See our Privacy Policy for exactly what does and doesn't leave your browser.
- You grant Strata and its printing partner a limited, non-exclusive license to use the data and design you submit only as needed to generate, print, and ship the product you order. We do not use it for anything else.
- You agree not to: use the Service for anything unlawful; upload content that infringes anyone's rights; attack, probe, overload, scrape, or interfere with the Service or the third-party services it connects to; or attempt to reverse engineer, resell, or commercially exploit the Service.
5. The AI Reading
- The Reading uses your own Anthropic API key under your own Anthropic account. You are responsible for that account, its costs, and your compliance with Anthropic's terms.
- Readings, archetypes, the "Crystal Ball," and all similar content are generated entertainment and reflection, computed from listening patterns. They are not psychological, medical, financial, or professional advice, and not a factual assessment of you or of any artist.
- AI-generated text can be inaccurate. Don't rely on it for anything that matters.
6. Orders, pricing, and payment
- Placing an order is an offer to buy. A contract forms only when we accept the order by beginning fulfillment; until then we may decline or cancel any order, for example for suspected fraud, ordering-tool errors, or an obvious pricing or product-description mistake, and if you were already charged we will refund you in full.
- Prices are shown at checkout and charged in USD via Stripe. You authorize us (through Stripe) to charge your payment method for the total shown, including any applicable taxes and shipping.
- Taxes. You are responsible for any sales, use, VAT, customs, or import duties that apply to your order. Where we are required to collect tax, it is added at checkout; where we are not, you remain responsible for any tax you owe.
- Shipping and risk of loss. Shipping timelines shown on the site are estimates, not guarantees. Risk of loss passes to you when the carrier takes possession, but our Refund Policy still covers items lost or damaged in transit, as described there.
7. Merchandise and personalized artwork
- Products are printed to order by our print partner (Printify) and are personalized from your data; each one is made specifically for you. Apparel sizing is confirmed by email after checkout. Product colors may differ slightly from on-screen previews; screens and fabric render color differently.
- Artwork on your products is generated from your own listening data (for example, the names of artists you listen to) and is produced for your personal, non-commercial use. You may not resell Strata-generated products commercially.
- You represent that your use of the design you order does not infringe or violate anyone's rights, and you are responsible for the data you choose to turn into a product.
- Refunds and replacements are governed by our Refund Policy.
8. Intellectual property, and how to report a concern
- The Service (its design, code, and generated visual styles) belongs to Strata. Artwork and images generated from your data are yours to use personally (share them, print them, post them).
- Strata is not affiliated with, endorsed by, or sponsored by Spotify, Apple, Anthropic, or any artist or record label. All trademarks belong to their respective owners. Artist names appearing in your visualizations and products come from your own listening history, are used descriptively to reflect what you listened to, and are not sold as endorsed or licensed artist merchandise.
- Takedown / complaints. If you are a rights holder (including an artist or their representative) and believe content offered through the Service infringes your copyright, trademark, or right of publicity, email stratamusic.conry@gmail.com with a description of the work or name at issue, the specific product or page, your contact information, and a statement of your good-faith belief and authority to act. We will review promptly and, where appropriate, remove content or decline to print it. This is our designated contact for notices under the U.S. Digital Millennium Copyright Act and for other rights complaints.
9. Third-party services
The Service connects to independent third parties, including Spotify and Apple (as the source of your export), Anthropic (for the optional Reading), and Stripe, Printify, and Resend (for purchases and emails). We are not responsible for those services, their availability, or their acts and omissions, and your use of them is governed by their own terms and policies.
10. The Service is provided "as is"
To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted or error-free availability. Your listening statistics are computed from the file you provide and may contain errors.
11. Limitation of liability
To the fullest extent permitted by law, Strata's total liability for any claim arising out of or relating to the Service or these Terms is limited to the greater of the amount you paid us in the twelve months before the claim arose, or twenty U.S. dollars; and we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of the two sections above may not apply to you. Nothing in these Terms limits any liability that cannot be limited under applicable law, including your non-waivable rights under the Massachusetts Consumer Protection Act (Chapter 93A).
12. Indemnification
You agree to indemnify and hold harmless Strata from any claims, damages, losses, and reasonable costs (including attorneys' fees) arising out of your breach of these Terms, your misuse of the Service, or content or data you submit, including any claim that data or a design you submitted infringed or violated someone's rights.
13. Resolving disputes
We would much rather fix a problem than fight about it. Before filing any lawsuit, you agree to first email us at stratamusic.conry@gmail.com and give us 30 days to resolve the issue. Most problems are solved this way.
- Class-action waiver. To the extent permitted by law, you and Strata agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any class, collective, or representative action.
- Time limit. To the extent permitted by law, any claim arising out of or relating to the Service or these Terms must be brought within one year after it arises, or it is permanently barred.
- Small claims. Nothing here prevents either of us from bringing an individual claim in small-claims court.
These Terms do not require binding arbitration; disputes that are not resolved informally are handled by the courts identified below.
14. Governing law and venue
These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law rules. Except for claims that may be brought in small-claims court, the state and federal courts located in Massachusetts have exclusive jurisdiction, and you consent to their jurisdiction, except where applicable law gives you the right to proceed in your home jurisdiction.
15. Suspension and termination
We may suspend or discontinue the Service, or restrict your access to it, at any time, including if you misuse it or breach these Terms. The sections that by their nature should survive (including data ownership, IP, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law) survive any termination.
16. General
- Changes. We may update these Terms; the effective date above will change when we do. Continuing to use the Service after a change means you accept the updated Terms.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including supplier or carrier failures, outages, natural events, labor disruptions, or governmental actions.
- Severability. If any provision is found unenforceable, the rest stay in effect, and the unenforceable provision is limited to the minimum extent necessary.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms; we may assign them, for example in connection with a sale of the business.
- Entire agreement. These Terms, with the Privacy Policy and Refund Policy, are the entire agreement between you and Strata about the Service and supersede any prior understandings. There are no third-party beneficiaries.
- Electronic communications. You consent to receive communications from us electronically (by email and on the site), and you agree that electronic agreements and records satisfy any legal requirement that such communications be in writing.
